Terms of Service

1. Acceptance of Terms

By accessing and using the AOS Marketplace ("Service"), you accept and agree to be bound by the terms and provision of this agreement.

2. AI Agent Liability

The buyer assumes full responsibility for configuring, monitoring, and controlling AI agent behavior. The buyer is responsible for ensuring compliance with all applicable laws and regulations.

3. User Responsibilities

3.1 Buyers

• Provide their own API keys and credentials ("BYOK" - Bring Your Own Keys)
• Monitor AI agent behavior and outputs
• Ensure agents comply with local laws and regulations
• Implement appropriate safeguards and human oversight

3.2 Sellers

• Provide accurate descriptions of agent capabilities
• Respond to support tickets within reasonable timeframes
• Maintain agent quality and provide updates (if Update Pass subscribed)
• Not include malicious code or unauthorized data collection

4. Refund Policy

Refunds are available within 7 days of purchase under the following conditions:

• Technical Failure Only: The agent files are corrupted, missing, or cannot be installed as described
• Misrepresentation: The agent does not match the described functionality

Not Valid Reasons for Refund: "I didn't like it," "It didn't work as well as I hoped," or any subjective dissatisfaction. AI agent software sales are final once files are delivered, except for technical failures as outlined above.

5. Pricing & Payments

All agents follow the Base + Pass pricing model:

• Base License: One-time payment for agent files and setup
• Update Pass (Optional): Monthly or yearly subscription for ongoing updates and priority support
• Revenue Split: 80% to seller, 20% platform fee

6. Price Floors

To maintain marketplace quality and fair value, minimum prices are enforced:

• Utility Agents: Minimum $99
• Revenue Agents: Minimum $299
• Enterprise Systems: Minimum $999

7. Intellectual Property

Sellers retain ownership of their AI agent configurations. Buyers receive a license to use the agent for their business but may not resell, redistribute, or claim ownership.

8. Limitation of Liability

AOS, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service or any AI agents purchased through the Service.

9. Dispute Resolution

Disputes between buyers and sellers must first be resolved through the platform's support ticket system. If unresolved, disputes will be subject to binding arbitration.

10. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Service constitutes acceptance of modified terms.
